The Kagan Abortion Distortion Spreads

We’ve highlighted Shannen Coffin’s analysis of documents  from Obama Supreme Court nominee Elena Kagan concerning partial-birth abortion. It is interesting to see how far her distortion from in 1996 spread. 

When she twisted the words of The American College of Obstetricians and Gynecologists (ACOG) her distortion entered the bloodstream of American political debate. In documents released by the Clinton library, Elena Kagan commented that it “would be a disaster” if the ACOG memorandum would become public.  ACOG stated “the vast majority of cases, selection of the partial-birth procedure is not necessary to avert serious adverse consequences to a woman’s health.” Instead she pushed aside science and in search of a political victory and proposed the ACOG include the following language “An intact D&X [medical term for partial birth abortion], however, maybe the best the most appropriate receipt you’re in a particular circumstance to save the life or preserve the health of a woman.”

12 years later the Senator Obama refers to the ACOG statement in his pro abortion speech to Plannned Parenthood:

Obama ends his speech with these words: “It’s time for us to change that. It is time for a different attitude in the White House. It is time for a different attitude in the Supreme Court. It is time to turn the page and write a new chapter in American history.”

These are words to remember during this political season as we begin to turn the page on the last two years of American history.

Abortion Distortion By Obama Nominee

Shannen Coffin has an INCREDIBLE piece running on NRO today on the abortion issue and a partial birth abortion case. It is a chilling example of how Obama’s nominee for the Supreme Court Elena Kagan cooked the legal books for political gain.

When President Obama promised in his Inaugural Address to “restore science to its rightful place,” he never explained what that rightful place would be. Documents recently released in connection with the Supreme Court nomination of Solicitor General Elena Kagan suggest an answer: wherever it can best be used to skew political debate and judicial outcomes.

 The documents involved date from the Clinton White House. They show Miss Kagan’s willingness to manipulate medical science to fit the Democratic party’s political agenda on the hot-button issue of abortion. As such, they reflect poorly on both the author and the president who nominated her to the Supreme Court.

From the Lips of Walter Dellinger to the Ears of God

What was probably a publicity stunt to energize pro-abortion activists on the eve of the nomination hearings of Obama’s latest Supreme Court pick Elena Kagan, former acting Solicitor General Walter Dellinger predicted Tuesday night that the Supreme Court will overturn Roe vs. Wade, the landmark decision that brought about the murder of millions of children.  The POLITICO today reports

The noted liberal scholar said the 1973 decision has become a “trophy” that the court’s conservative bloc could overturn if a Republican president chooses a replacement for Justice Anthony Kennedy.

“I absolutely believe it,” Dellinger said during a forum cosponsored by POLITICO. 

“For a while I thought that one could simply chip away at a lot more and more regulations that sort of protected access (to abortions) for the most affluent women but really made it impossible for women who were vulnerable to geography, poverty (and) youth,” he added. “But now I think that, actually, it is such a symbol of a kind of jurisprudence that conservatives have set themselves in opposition to.”

Writings of Supreme Court Nominee Kagan

For two weeks on Friday afternoon the Clinton Library released public documents belonging to President Obama’s Supreme Court nominee Elena Kagan.  Writings from her time in the Clinton White House are quite troubling.  Carrie Severino of the Judicial Crisis Network has written extensively concerning the documents and posted summaries here and here. Catholics and people of faith should be concerned about these points:

Abortion.  Kagan helped President Clinton articulate his position against the Hyde Amendment and in favor of federal funding of abortion.  She corresponded with the Legal Director of NARAL regarding trying to slow the progress of passage of the Child Custody Protection Act which would have made it a federal offense to transport a minor across a state line for an abortion to avoid parental consent laws.

On the other side of the issue, Kaganrecommended for political reasons that President Clinton sign a partial birth abortion ban with Daschle’s amendment for a health exception, despite his own Department of Justice advising him that such a law would be unconstitutional and his administration’s general opposition of the law.  Of course the breadth of the term “health” as legally interpreted is sufficient to make any ban on partial birth abortion practically meaningless, and in 2007 the Supreme Court found that even a ban of the procedure without a health exception was constitutional.
 
Kagan believes the constitution contains a nearly unfettered right to partial-birthabortion, an extreme position the Supreme Court ultimately rejected.  She opposed a ban on partial-birthabortion, even one with an exception for the mother’s health, because she believed it took away one “safe” abortion technique from abortion providers and thus burdened the right of women to abort their pre-viable children for literally any reason they pleased.  The Supreme Court, by contrast, upheld a partial birth abortion ban even without a health exception and cited the state’s substantial interest in “promoting respect for human life at all stages in the pregnancy” by not allowing “a doctor to pierce the skull and vacuum the fast-developing brain of [a mother’s] unborn child, a child assuming the human form.”
 
Religious language.  Kagan was asked to clean up a video-taped speech given by the President commemorating the 25th anniversary of Roe v. Wade. She appears to have recommended deleting the “God bless you” salutation at the end of the speech.

Pro-Lifers Weigh In On Obama Supreme Court Nominee, Elena Kagan

Pro-life groups are speaking out today against President Obama’s Supreme Court nominee, Elena Kagan. There isn’t much of a paper trail on Kagan but from what pro-lifers have been able to glean, and the fact that NARAL has thrown their support behind her, confirming Kagan would be a serious setback for the unborn.

President Obama said just recently that while he doesn’t have a litmus test for a nominee, he does want ”somebody who is going to be interpreting our Constitution in a way that takes into account individual rights, and that includes women’s rights.” We have to presume Kagan fits that description.

A big concern that is Kagan has indicated she may be sympathetic to using international laws to make and interpret laws in the US, including an unlimited abortion right.

Wendy Wright, president of Concerned Women for America, told LifeNews.com that “abortion groups are actively attempting to create the impression that international norms require countries to provide access to abortion. During Kagan’s nomination hearing for Solicitor General, Senator Specter questioned her about the use of foreign sources of law in constitutional decision-making.”

Students for Life of America launched www.IOpposeKagan.com this morning and are asking people to sign a petition in opposition to confirming Elena Kagan.

And Charmaine Yoest, president of Americans United for Life, said that “Elena Kagan has strong ties to abortion-advocacy organizations and expressed admiration for activist judges who have worked to advance social policy rather than to impartially interpret the law.”

On background on Elena Kagan, AUL revealed that:

Kagan not only publicly and repeatedly criticized federal regulations that prohibited recipients of Title X family planning funds from counseling on or referring women for abortions, she argued that the regulations amounted to the subsidization of ‘anti-abortion’ speech. Kagan will further entrench the Court’s self-appointed role as the sole arbiter of abortion policy because she believes the role of judges is to ‘advance’ social policy rather than faithfully apply the law.

Oops, She Did It Again

We’d rather not write about this since it’s so depressing but hopefully bishops will take into account Nancy Pelosi’s loooong list of public transgressions against the Roman Catholic Church, of whom she considers herself a member, and consider serious disciplinary actions.

It’s time for Pelosi to take some serious heat for her anti-Catholic comments, not necessarily because they are anti-Catholic, but rather because she is a public figure who claims to be Catholic and because of her power, heretical statements she spouts frequently can lead the faithful astray.

She praised the nuns who threw their support behind the healthcare reform legislation the week before it was voted upon in the House of Representatives. When speaking to the Catholic Community Conference yesterday, she said this:

“I thank so many of you who helped get that passed. Thank God for the nuns. Thank God for the nuns

“Thank God for the nuns — and nuns, imagine, 50, 60 leaders of orders representing 59,000 orders — and I didn’t realize it was Dominican, Benedictine and Franciscan, Notre Dame de L’Amour, Notre Dame School Sisters, every possible kind of name you can think of, there they were on the list.  And they wrote to us saying, ‘We support this life-affirming legislation.’ We were so proud of them and they helped us do just that.”

Thankfully Bishop Brandt, near Pittsburgh, already publicly chastised an order of nuns who signed that letter to Obama in the 11thhour in support of the pro-abortion healthcare legislation by refusing to allow them to recruit new members in his district.

Pelosi should be next in line.

Nuns Face Consequences of Supporting Healthcare Reform Bill

During the tail end of the healthcare reform fight, several supposedly Catholic orders of nuns weighed in for the bill, even though it funded abortion and didn’t protect the conscience rights of healthcare professionals. They signed a letter that went to President Obama on March 17th in support of the bill, which was in direct opposition to the US Conference of Catholic Bishops.

 Some of those nuns, specifically the Sisters of St. Joseph, are now facing the consequences for publicly supporting the atrocious legislation – they are being barred from recruiting new nuns in a diocese in Pennsylvania, right outside of Pittsburgh. The nuns are launching a recruiting drive through ads and community events and Bishop Lawrence Brandt has refused to allow them to add to their members when they so blatantly opposed the Church by publicly supporting the healthcare legislation and the Church’s teachings regarding the sanctity of life.

Brandt “has a right to disapprove a request from a religious community that wants to host a recruitment event when that community has taken a public stance in opposition to the church’s teaching on human life,” the diocese said in a statement dated April 15.

“Furthermore,” the statement continued, “an environment of dissent from and public opposition to the positions of the U.S. Catholic bishops does not provide an appropriate seedbed for vocations.”

Bishop Brandt isn’t alone. In Providence, R.I., the bishop there ordered a “diocesan-sponsored health care system to withdraw from the Catholic Health Association, which also supported the health care bill.”

We are glad to see the bishops exercising their roles as teachers of the faith and taking actions to uphold the Church’s teachings and reprimand those who publicly oppose and encourage dissent from the teachings of the Church.

New Abortion Clinic Opens Up in MI Because of Healthcare Law

In Bart Stupak’s home state of Michigan, a new abortion clinic is opening up as a direct result of the new healthcare bill that funds abortion on demand with government dollars. If you remember, Congressman Stupak caved at the 11th hour, providing the crucial votes needed to pass the monstrosity of a bill, delivering a huge blow to the pro-life agenda, to the autonomy of Americans and to the nation’s economy.

From the Detroit News-

An early sign of health care reform’s impact is Planned Parenthood’s decision to open a new Oakland County clinic within the next 18 months, adding to 15 locations, including Detroit, Warren and Livonia. Unlike other Detroit area centers, the new location is likely to include abortion services.

[Planned Parenthood president Cecile] Richards and Lori Lamerand, executive director of Planned Parenthood of Mid and South Michigan, are ramping up for a boom in birth control and other reproductive services — what Lamerand calls “an onslaught” of women poised to gain new access to reproductive health care.

Now that women will be able to not only get access to more birth control but they will be able to finally get those free, or at least government-subsidized, abortions that so-called women’s rights groups have been clamoring for.

Planned Parenthood will say that abortions aren’t their main focus. However, Abby Johnson, the former Planned Parenthood director at a large clinic in Texas, told ABCNews, among other outlets, that her supervisors were “pushing clinics that did have an abortion program to bring in more money.” Abortion is a money-maker, period.

And even the Guttmacher Institute, the research arm of Planned Parenthood, says that when abortion is subsidized, abortion rates among those women enrolled in Medicaid could increase 28%.

We predict this is only the beginning. The healthcare bill also provides $11 billion to Community Health Centers, many of which do abortions. Like we always said, the bill is the largest expansion of abortion since Roe v. Wade and the abortion industry stands to gain a huge windfall, thanks to President Obama, his allies in Congress and of course, to Bart Stupak.

Does Anyone Expect a Good Supreme Court Nominee from Obama? No.

President Obama, who is probably worn out from the year long healthcare battle, has yet another fight ahead as he prepares to pick his 2nd nomination for the Supreme Court. The Supreme Court is a very powerful entity and can and has delivered quite a few blows to the pro-life agenda in the past several decades.

Picking the right Justice, even though they are nominated by the Executive branch of government, begins in the voting booth. It is crucial to vote into office people who have solid values and morals, built on firm Christian principles, if we want our Justices to reflect those same values that we hold so dear.

If Americans elect a President who, say, voted several times against protecting babies who are born alive after a botched abortion, what is the likelihood that he would nominate a pro-life Justice that adheres to the Constitution and respects the right to life? Very little.

 CNN released a poll yesterday that showed most Americans think that Obama will nominate a liberal to replace Justice Stevens BUT that one in four don’t want that to happen. Of those polled, “37 percent saying they want Obama to name a moderate and 36 percent pulling for a conservative candidate.”

 This is what happens when America elects a liberal President – we get liberal Justices.

And just to be sure we all know where Obama stands, yesterday he said that while there’s no litmus test for his nominee, “he will make sure his choice ‘takes into account individual rights, and that includes women’s rights.’”

 This is why elections are so crucial. The healthcare reform bill, which funds abortion on demand with government funds, will no doubt be challenged in court and it is very likely the ultimate decision will be made at the Supreme Court level as to whether or not the legislation is Constitutional.

Bart Stupak’s Betrayal

For the Editors of St Michael Society, the shock over Bart Stupak’s betrayal this weekend has begun to turn into anger and grief. Its one thing to cave to pressures and intimidation but Stupak’s speech on the House floor sheds new light on the man. This was not a man who changed his vote because he was worn down by attacks. Bart Stupak’s speech on the House floor revealed a man, who in the end, decided to put the Democratic Party ahead the life of the unborn, the lives of women who will suffer from abortion, obedience to the bishops and sadly his faith. We need to pray for him and we must work to undo the damage he has done.

Unfortunately, if Bart Stupak truly wanted to ensure that human dignity was respected in this legislation, he wouldn’t have surrendered. But surrender he did — and then some, declaring the Democratic party the protectors of the unborn on the House floor last night.

The Democratic party is nothing of the sort — which is another reason no one who wanted to defeat the taxpayer funding of abortion in Obamacare should have expected a Stupak-led victory in this Washington environment. It’s the party that will never offend the abortion industry. It’s the party that owns partial-birth abortion.

By caving at the last hour, he discredited all who stood with him. (What does it say about Ohio’s Marcy Kaptur and Pennsylvania’s Chris Carney that they had already agreed to vote yes even before the fig leaf of the executive order had come through?) In addition to undermining an encouraging partnership with pro-lifers across the congressional aisle, Mr. Stupak signaled that, in the end, you can’t count on pro-life Democrats.

Let me be clear: any representative, including Rep. Stupak, who votes for this healthcare bill can no longer call themselves ‘pro-life.’ The Susan B. Anthony List Candidate Fund will not endorse, or support in any capacity, any Member of Congress who votes for this bill in any future election. Now through Election Day 2010, these representatives will learn that votes have consequences. The SBA List Candidate Fund will work tirelessly to help defeat Members who support this legislation and make sure their constituents know exactly how they voted.

…in the 11th hour, he caved. He succumbed to the pressures of the most pro-abortion Administration in history just because they said they would write on a piece of paper that the federal government won’t fund abortion. It’s not even a law the President wrote. It’s not worth the Post-It note he wrote it on.

 Shame on you Bart Stupak. Shame on all the other Members who walked the plank with you. You all sold out and scorned millions of voters who trusted you and believed in you.
